Terms and Conditions
We have detailed our personal terms and conditions below which you must agree to in order to register and purchase with our website. These Terms and Conditions are there for your online safety.
Terms & Conditions of Toro Teamwear
Definitions:
Company: Toro teamwear
Customer: Any party on whose behalf business is done or to whom goods are sold
In writing: means by email or snail mail
General:
All business done is subject to these conditions. Any change in conditions must be approved by the director or secretary
Delivery: Delivery times are approximations. Every effort shall be made by the company ot adhere to the requested/agreed delivery time, however this in no way implies legal obligation to delivery on the due date nor is it a reason to withhold payment. The company must be contacted at least 2 weeks in advance of the delivery time to notify of any shortages.
Materials: Quality of sample is usually the quality of supply. It is customer responsibility to check sizing of product, dimensions, spelling and colour matching of the transfers prior to using and all else before and after ordering. Any incorrect prints will be rectified free of charge if notified within 2 weeks of delivery date.
Colours:
Colours may vary slightly from photograph.
Sizing:
We reserve the right to alter specifications (design, colours, fabrics, sizing) which will help to improve our products. We accept no liability for any misprints.
Forces Beyond Our Control:
If there are any forces beyond our control such as war, natural disasters or other such factors, the company reserves the right to deliver goods within a reasonable period. If this is not possible and all other avenues are exhausted, the customer may apply for a full refund.
Retention of Title:
Goods remain the property of Toro Teamwear until full payment is received.
Promotion & Advertising:
We reserve the right to use any artwork we may have produced for our own marketing and other promotional purposes unless request is made in writing prior to contract and process of order.
Prices:
The Company reserves the right to alter prices. Goods will be invoiced at the prices ruling on the day of dispatch unless agreed in writing by the Customer and the Company. VAT is charged at the rate ruling the date of dispatch. Carriage will be charged on all orders unless collected.
We will endeavour to advise on any change in cost. This may occur due to change in cost of raw materials, labour, fuel or other factors.
Loss or Damage in Transit:
Any complaints from loss or damage of the order in transit must be received by the company within 14 days of the date that the goods were ordered. The Company will replace all transfers lost or damaged by its carriers within a reasonable time period.
Payment:
Non Account Customers
Payment for all goods is required at the time the order is placed. If you would like to pay by cheque please print your order and post it with your cheque to our Sales Department at the address on our contact page.
Account Customers:
Payment of accounts is to be strictly 30 days from the invoice date.
Any cheques must be cleared prior to order being confirmed. The company reserves the right to refuse to process any orders and not to deliver any goods if the Customer has not made payment or is trading above the credit limit. The accuracy of any orders made by telephone cannot be guaranteed. Orders must be made by email.
Non-Payment of Outstanding Invoices:
If outstanding invoice is unpaid and no attempts made to pay or make arrangements to pay, Toro Teamwear will pass the outstanding amount to an external collection agency. This will incur further costs to the customer dependent upon the amount charged by the agency.
Claims:
Any claims in respect of faulty goods must be made within 7 days of receipt of goods. Claims will be limited to the value of disputed invoice. They shall neither be grounds for withholding payment of other invoices nor give the Customer the right to set off the amount claimed against payment due of other invoices.
Law:
All agreement between the Company and its Customer shall be governed by English Law and be within the exclusive jurisdiction of the English Courts.
Cancellation of Orders:
Cancellation of any job in progress must be confirmed in writing as soon as is practicably possible. All costs incurred in the setting-up, proofing and preparation of any job that is cancelled without due notice will be charged to the customer. The charge will be in relation to the point at which the job is cancelled and will cover all work produced in-house and subcontracted out.
Distance Selling Regulations:
These regulations do not apply to any item or product that we have customised at your request. For returns of correctly supplied stock items please see the section below for 'Returns'.
Returns
Stock Goods:
You can return any stock item in its original condition to us with 7 days after the day of receipt with any seals and shrink-wrap intact, clothing must have labels attached. We will issue a full refund for the price you paid for the item for correctly returned orders. Bear in mind that we cannot accept returns of bespoke items that have been personalised on your request. Toro Teamwear recommends that you use a recorded mail service for returning items.
Faulty Goods:
Should you receive a faulty item please email us immediately on info@toroteamwear. We will replace or repair the damaged item, whatever is most suitable.
